Our digital assets are typically lost when we die.
As part of the modern digital world, we use a vast array of Internet applications to store and share our data. From social media to photo sharing applications, our presence in life is our legacy in death. Ensuring that our legacy is well maintained after we pass is often not addressed in our Wills or instructions to others when we die. The capturing and maintaining these assets is a core part to being able to administer your wishes when you die.
Managing digital assets centrally is hard
Digital assets are typically maintained in emails and or in rare occasions password managers. Bringing these together as a digital asset register is harder to do after you pass. A central register of not only the asset (photos or documents for example) but a link to your instructions on how these should be dealt with is needed.
Dealing with the assets when we die is difficult and expensive
The executor administrator of the Will is responsible for servicing the instructions from the deceased and allocating assets as instructed. Significant time and expense is often the result of pulling together the digital assets, and ensuring they are dealt with correctly. This activity can include expensive legal costs and e-discovery services from 3rd parties. The result is a higher cost to service the will, and additional stress on the administrators and family during this time.
Our digital assets have value, and need to be better managed
Digital assets can often be financial in nature. Emerging assets such as NFT and digital crypto currency currently could be overlooked if they are not recorded or maintained as part of the asset register. The impact of not having these managed is they remain unclaimed and potentially lost to the families or beneficiaries.
Tracking digital footprints is hard to achieve post passing
Without a maintained asset register, investigation and e-discovery of assets post mortem is much harder to undertake. Over the course of a lifetime, 100's if not 1000's of applications and services from different providers are created, some of these become unused or dormant. There is a duty to ensure that the closedown or transfer of these accounts is made to the Will administrators as part of the execution of the Will.
